AI Regulation: Understanding the Divergent Approaches of the UK and EU

On 6th February 2024, the UK Government proposed a pro-innovative approach in response to the previous year's White Paper consultation on AI Regulation. The primary objective is to strike a balance between fostering innovation and ensuring safety by leveraging the current technology-neutral regulatory framework for AI. Moreover, the UK government acknowledges the necessity for legislative measures.

In the white paper on AI regulation, the UK government has laid out five key principles for the responsible regulation of artificial intelligence (AI).


  • Safety, security, and robustness

  • Appropriate transparency and explainability

  • Fairness

  • Accountability and governance

  • Contestability and Redress

EU AI Act


Across the Channel, the EU is taking a markedly different approach. The EU's AI Act adopts a risk-based approach, categorising AI systems into levels—unacceptable, high, limited, and minimal/no risk—based on their potential to cause harm. This comprehensive framework ensures that AI systems are governed according to their risk profiles, fostering trust and accountability in their development and deployment. Unacceptable risk systems, such as those used for social scoring or behavioural manipulation, are outright prohibited. High-risk systems, including those in critical sectors like education, law enforcement, and employment, face stringent requirements for risk management, transparency, and data governance. Meanwhile, limited and minimal-risk systems must meet basic transparency standards, such as informing users they are interacting with AI. By tailoring obligations to the level of risk, the EU aims to address the unique challenges posed by AI while encouraging its responsible and ethical use.

Key Differences
